Tällä hetkellä eduskunnassa on käsittelyssä niin sanottu käännytyslaki. Laki on tänään perustuslakivaliokunnan uudessa käsittelyssä ja uudessa asiantuntijakuulemisessa Edellisellä kerralla kaikki 18 asiantuntijaa tyrmäsivät lain. Sen tarkoituksena on ehkäistä Venäjän hybridivaikuttamista. Käytännössä laki merkitsisi, että turvapaikan tarpeen arviointi ja siitä tehty päätös voitaisiin panna toteen rajalla. Arvioinnin tekisivät rajavartijat ja heillä olisi oikeus käännyttää hakija. Tämä käytännössä estäisi turvapaikan hakemisen, sillä kunnollista turvapaikan tarpeen arviointia ei ole mahdollista tehdä näillä ehdoilla.
Lakiesityksen ollessa perustusvaliokunnan käsittelyssä, kaikki asiantuntijat vastustivat lain hyväksymistä. Tämän jälkeen esitys on ollut hallintovaliokunnassa, ja SDP:n edustajat ovat vaatineet siihen muutoksia. Käytännössä lakiesitys on pysynyt kokonaisuutena ennallaan. Käännytyslaki on kansainvälisten sopimusten ja perustuslain vastainen, sillä se rajoittaa turvapaikanhakua. Ainoa tapa turvata ihmisoikeusnormien noudattaminen on hylätä lakiesitys.
Käännytyslaki asettaisi turvapaikanhakijat vaaraan, sillä se eväisi heiltä oikeudenmukaisen ja perusteellisen turvapaikanhakuprosessin. Käännytyslaki olisi uhka erityisen haavoittuvassa asemassa oleville, kuten lapsille ja seksuaali- ja sukupuolivähemmistöille, sillä erityistä suojelun tarvetta ei voida varmuudella selvittää käännytyslain mukaisella prosessilla. Käännytyslaki asettaisi myös rajavartijat työntekijöinä ongelmalliseen asemaan, kun he joutuisivat ottamaan vastuun päätöksistä, jotka voisivat määrittää turvapaikanhakijan henkiinjäämisen.
Eduskuntapuolueista ainoastaan Vasemmistoliitto ja Vihreät eivät kannata kyseistä esitystä. Sosiaalidemokraatit tuntuvat olevan täysin hukassa siitä, pitääkö puolue kiinni ihmisoikeuksista ja perustuslaista vai kerääkö poliittisia irtopisteitä. Silti juuri demarit ovat ratkaisevassa asemassa lain hyväksymisen osalta. Vetoamme SDP:n edustajiin käännytyslakiesityksen hylkäämiseksi.
Vasemmistonuorten kanta on selvä – käännytyslakia ei tule missään tapauksessa hyväksyä. Jos eduskunta hyväksyy esityksen, Suomi ei enää mitenkään voi väittää olevansa ihmisoikeusmyönteinen oikeusvaltio.

The adoption of the Pushback Act is a threat to human rights and the rule of law
At the moment, the so-called pushback law is under consideration in the parliament. Today, the law is going to the Constitutional Law Committee for a new hearing and a new expert consultation. Last time, all 18 experts rejected the law. Its purpose is to prevent Russia’s hybrid operations. In practice, the law would mean that the assessment of the need for asylum and the asylum decision could be conducted at the border. The assessment would be made by the border guards and they would have the right to turn the applicant away. This would effectively prevent asylum seeking, as it is not possible to make a proper assessment of the need for asylum under these conditions.
While the bill was being considered by the Constitutional Committee, all the experts opposed the adoption of the law. Since then, the motion has been in the Administration Committee, and Social Democrat representatives have demanded changes to it. In practice, the bill has remained unchanged as a whole. The Pushback Act is against international agreements and the Constitution, as it restricts asylum seeking. The only way to ensure compliance with human rights standards is to reject the bill.
The Pushback Act would put asylum seekers at risk, as it would deny them a fair and thorough asylum application process. The Pushback Act would be a threat to those in a particularly vulnerable position, such as children and sexual and gender minorities, because the special need for protection cannot be ascertained with certainty through the process proposed by the Pushback Act. The Pushback Act would also put border guards as employees in a problematic position, as they would have to take responsibility for decisions that could determine the survival of an asylum seeker.
Among the parties, only the Left Alliance and the Greens do not support the proposal in question. The Social Democrats seem to be completely lost about whether the party sticks to human rights and the constitution or collects political points. Still, it is the Social Democrats who are in a decisive position when it comes to passing the law. We appeal to members of parliament of the Social Democratic Party of Finland to reject the Pushback Act.
The position of the Left Youth is clear – the Pushback Act should not be accepted under any circumstances. If the parliament approves the motion, Finland can no longer claim to be a state governed by the rule of law that favors human rights.
